Terms of Use

1. Acceptance of these Terms

These Terms of Use ("Terms") are an agreement between you and Julien Zanet, an individual developer based in France who publishes DripCheck ("we", "us", "our"). They apply to the DripCheck iOS app and its related services (the "Service").

By downloading, installing or using DripCheck, you agree to these Terms. If you do not agree, do not use the app. Our Privacy Policy explains how we handle your personal data.

2. The Service

DripCheck is an iOS app that uses artificial intelligence to analyze photos of your outfits. It gives each outfit a score from 0 to 10 with written style feedback. It also lets you keep a digital closet of the pieces it recognizes, follow your progress, ask questions about a look and compare outfits.

We work to improve DripCheck, so features may change, be added or be removed over time.

3. About the AI scores and advice

• Scores, feedback, answers and closet suggestions are made automatically by third-party AI models. They are automated opinions about style, not facts.
• They can be wrong, incomplete or inconsistent. The same outfit can get a different score in a different photo, light or pose.
• They are not professional advice of any kind, including medical, psychological, nutritional or body image advice.
• DripCheck judges clothes, fit and styling only. It is not a judgment of your body, face, weight, attractiveness or worth, and it is not designed to comment on them. If you get an answer that comments on your body or appearance, or that seems inappropriate, please report it to [email protected].
• You decide what you wear and what you buy. Use the feedback as one opinion among others.

4. Who can use DripCheck

You must be at least 13 years old to use DripCheck. If you are under the age of digital consent in your country (15 in France), or under the age at which you can enter into a contract on your own, you may use DripCheck only with the permission of a parent or guardian, who accepts these Terms for you. Purchases by minors are also subject to Apple's rules.

5. Your account

When you first open the app, it creates an anonymous account so that you can try the free baseline scan. To use DripCheck after that, you must create an account with Sign in with Apple. An account is required because your scans, photos, closet and history are stored on our servers and follow you across your devices.

You are responsible for keeping access to your Apple ID secure and for the activity on your account. An account is for one person. Tell us at once if you think someone else has used your account.

6. Subscriptions and billing

• DripCheck requires a paid subscription. We offer weekly and annual auto-renewable subscriptions, sold through Apple's App Store. There is no free trial.
• The price, the length of each period and what is included are shown in the app before you buy. Prices are in your local currency and set through the App Store.
• Payment is charged to your Apple ID account when you confirm the purchase.
• Your subscription renews automatically for the same period unless you turn off auto-renewal at least 24 hours before the end of the current period. Your Apple ID account is charged for the renewal within the 24 hours before the end of the current period.
• You can manage or cancel your subscription in your Apple ID account settings (on your iPhone: Settings > your name > Subscriptions). See how to cancel a subscription from Apple. When you cancel, you keep access until the end of the period you already paid for.
• If we change the price of a subscription, the change follows Apple's rules: Apple tells you in advance and, where Apple's rules require it, asks for your agreement before you pay the new price.
• Apple handles all payments and refunds. We cannot issue refunds ourselves. You can ask Apple for a refund under its policies (request a refund from Apple). Any right of withdrawal you have under consumer law for purchases made through the App Store is also handled by Apple under its terms.
• Deleting your account or the app does not cancel your subscription. You must cancel it in your Apple ID settings.
• If you reinstall the app or change devices, use "Restore purchases" in the app to get your subscription back.

7. The free baseline scan

During onboarding, before you subscribe, you can get one free baseline scan of an outfit. A limited number of attempts are available if a photo does not show an outfit. The baseline scan stays in your account, and its pieces are added to your closet after you subscribe. Every other feature requires a subscription.

8. Fair use and daily limits

To keep DripCheck fast and reliable for everyone and to prevent abuse, we apply daily limits. At the moment, you can make up to 30 scans and ask up to 40 questions a day, and ask up to 15 questions about one scan. In compare mode, each photo counts as one scan. The daily counters reset at midnight UTC. We may change these limits. The app tells you when you reach one.

9. Your content

Your content is the photos you add, your profile answers, your closet edits and the questions you ask. You keep all rights in your content.

You give us a non-exclusive, worldwide, royalty-free license to host, store, copy, process and adapt your content (for example, to make thumbnails and crops of each piece) only as needed to provide, operate, secure and improve the Service for you. This includes sending your content to the AI providers named in our Privacy Policy to make the analysis. We do not display your content publicly, sell it, or use it in advertising or marketing. We share it only with the service providers that help us run DripCheck.

This license ends when you delete the content or your account, except for copies kept for a limited time in backups and logs, as described in our Privacy Policy.

You may use the feedback and score cards that DripCheck makes for you for your own personal purposes, including sharing them.

10. Acceptable use

When you use DripCheck, you agree to:

• upload only photos of yourself, or photos that you have the right to use;
• not upload photos of other people without their consent;
• not upload photos of children or minors;
• not upload nudity, sexual content, or violent, hateful or illegal content;
• not use DripCheck to rate, mock, harass or harm other people;
• not try to get around the paywall, the daily limits or any security measure;
• not copy, scrape, reverse engineer or overload the Service, or access it with bots or other automated means;
• not use the Service or its outputs to build or train a competing product or AI model;
• follow the law that applies to you.

We may remove content or suspend an account that breaks these rules (see section 16).

11. Our intellectual property

DripCheck, including the app, its design, text, graphics, logos and software, belongs to us or to our licensors and is protected by intellectual property laws. We give you a personal, limited, non-exclusive, non-transferable and revocable license to use the app on Apple devices that you own or control, as allowed by these Terms and by the Usage Rules of the Apple Media Services Terms and Conditions. All rights we do not expressly give you are reserved.

12. Third-party services

DripCheck relies on services from other companies, such as Apple (Sign in with Apple, App Store), Supabase, Cloudflare, the AI providers, RevenueCat, Mixpanel and Expo. Our Privacy Policy lists them. Your use of Apple's services is also subject to Apple's terms. We are not responsible for services that are outside our control, but we choose our providers with care.

13. Apple App Store terms

If you downloaded DripCheck from Apple's App Store, the following also applies:

• Agreement. These Terms are between you and us only, not Apple. We, not Apple, are solely responsible for DripCheck and its content.
• License. Your license to use DripCheck is limited to a non-transferable license to use the app on Apple-branded products that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions. The app may also be used by other accounts linked to the purchaser through Family Sharing or volume purchasing, where available.
• Maintenance and support. We are solely responsible for providing maintenance and support for DripCheck. Apple has no obligation to provide any maintenance or support for the app.
• Warranty. We are solely responsible for any product warranties, whether express or implied by law, to the extent they are not effectively disclaimed. If DripCheck fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price of the app (if any) to you. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the app. Any other claims, losses, liabilities, damages, costs or expenses caused by a failure to conform to a warranty are our responsibility.
• Product claims. We, not Apple, are responsible for addressing any claims by you or a third party relating to DripCheck or your possession or use of it, including (a) product liability claims, (b) any claim that the app fails to conform to any applicable legal or regulatory requirement, and (c) claims under consumer protection, privacy or similar legislation.
• Intellectual property claims. If a third party claims that DripCheck or your possession and use of it infringes that third party's intellectual property rights, we, not Apple, are solely responsible for the investigation, defense, settlement and discharge of that claim.
• Legal compliance. You represent and warrant that (a) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country, and (b) you are not listed on any U.S. Government list of prohibited or restricted parties.
• Third-party terms. You must comply with any applicable third-party terms when you use DripCheck, for example the terms of your mobile data service.
• Questions and claims. Send any questions, complaints or claims about DripCheck to us, using the contact details in section 20.
• Third-party beneficiary. Apple and Apple's subsidiaries are third-party beneficiaries of these Terms. When you accept these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.

Apple's standard Licensed Application End User License Agreement also applies to your use of DripCheck. These Terms add to it. If the two conflict, these Terms apply, but nothing in these Terms reduces the rights that Apple's agreement gives Apple.

14. Disclaimer of warranties

To the extent permitted by law, DripCheck is provided "as is" and "as available". We do not promise that the Service will always be available, free of errors or secure, or that scores and advice will be accurate or meet your expectations.

Nothing in these Terms affects the rights you have as a consumer under mandatory law, including, in the European Union, the legal guarantee of conformity for digital content and digital services.

15. Limitation of liability

To the extent permitted by law, we are not liable for indirect or consequential losses, loss of profits, or decisions you make based on the AI's scores or advice. Our total liability to you for any claim relating to DripCheck is limited to the amount you paid for your subscription in the 12 months before the claim.

These limits do not apply to liability that cannot be limited or excluded by law, such as liability for death or personal injury caused by our negligence, for fraud, or for gross negligence or willful misconduct. If you are a consumer, this section applies only as far as the law of your country allows, and it does not remove your right to compensation when we fail to perform these Terms.

16. Ending your use of DripCheck

You can stop using DripCheck at any time. You can delete your account in the app (Profile > Your data > Delete account). This deletes your data as described in our Privacy Policy. It does not cancel your subscription, which you must cancel in your Apple ID settings.

We may suspend or close your account if you seriously or repeatedly break these Terms, abuse the Service or its limits, or put other users or the Service at risk. When possible, we will tell you first and explain why. You can contact us if you think we made a mistake.

If we decide to stop offering DripCheck, we will tell you in advance where possible. You can then ask Apple for a refund under its policies.

17. Changes to these Terms

We may update these Terms when DripCheck or the law changes. We will post the new version on this page and change the date at the top. If a change is important, we will also tell you in the app before it takes effect. If you do not agree with the new Terms, stop using DripCheck and cancel your subscription. If you keep using DripCheck after the new Terms take effect, you accept them.

18. Governing law

These Terms are governed by the laws of France. If you are a consumer living in another country, you also keep the protection of the mandatory provisions of the law of your country of residence.

19. Disputes

If you have a problem with DripCheck, please contact us first at [email protected]. Most problems can be solved quickly this way.

If we cannot solve it together, and you are a consumer, you may use the mediation or out-of-court dispute resolution options available to you under the law of your country.

Subject to mandatory rules, the French courts have jurisdiction over any dispute relating to these Terms. If you are a consumer living in the European Union, you can also bring a claim in the courts of the country where you live.

20. General terms and contact

If a court finds part of these Terms invalid, the rest stays in force. If we do not enforce a right at once, we do not give it up. We may transfer these Terms to a person who takes over DripCheck, as long as your rights are not reduced. These Terms, with our Privacy Policy, are the whole agreement between you and us about DripCheck.
